1. Introduction

These Terms and Conditions (“Terms”) govern your use of the 80/20 Japanese online Japanese language courses and related services provided by NattokuGo AB (org. nr. 559486-0263), trading as 80/20 Japanese, a Swedish aktiebolag with its registered office in Sweden (“we,” “us,” “our,” “80/20 Japanese,” or “NattokuGo”).

By accessing our website at course.8020japanese.com, creating an account, or purchasing any of our courses, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Services

2.1 Course Offerings

80/20 Japanese provides online Japanese language courses delivered through our learning platform. Currently, we offer the Foundations course, with additional courses potentially being added in the future.

2.2 Course Delivery

All courses consist of pre-recorded video lessons, audio versions, exercises, quizzes, and supplementary materials delivered through our self-paced online platform powered by WordPress and LearnDash.

2.3 Platform Access

You access our courses through our website hosted on our domain. An active internet connection is required to access course content.

3. Purchase Options and Pricing

3.1 One-Time Purchase (Lifetime Access)

When you purchase a course with a one-time payment, you receive lifetime access to that specific course, including all future updates and improvements to that course. This does not include access to other courses that may be launched separately in the future.

3.2 Subscription Plans

We offer monthly and yearly subscription options that provide ongoing access to designated course content for as long as your subscription remains active.

3.3 Pricing

  • All prices are displayed in the currency shown at checkout and include applicable VAT where required.
  • For one-time purchases, the price is paid once and provides lifetime access to the purchased course.
  • For subscriptions, you will be charged the subscription fee at the beginning of each billing period (monthly or yearly).

3.4 Price Changes

  • One-time purchases: The price you pay is final for that specific course purchase.
  • Subscriptions: We strive to maintain stable pricing for existing subscribers. Your subscription rate will generally remain locked at the price you initially subscribed at (grandfathered pricing). However, we reserve the right to adjust subscription prices in exceptional circumstances, including but not limited to significant increases in operational costs, currency fluctuations, changes in tax regulations, or changes to third-party service fees. If we need to adjust your subscription price, we will provide you with at least 60 days’ advance notice via email. You may cancel your subscription before the price change takes effect if you do not wish to continue at the new rate.

4. Payment and Billing

4.1 Payment Processing

Payments are processed securely through Stripe. We accept various payment methods including credit/debit cards, PayPal, and Klarna, subject to availability in your region.

4.2 Subscription Billing

  • Monthly subscriptions: You will be charged automatically every month on the anniversary of your subscription start date.
  • Yearly subscriptions: You will be charged automatically every year on the anniversary of your subscription start date.
  • It is your responsibility to ensure your payment information is current and valid. Failed payments may result in suspension or termination of your access.

4.3 Taxes

Prices may be subject to applicable taxes based on your location. Any required taxes will be calculated and added at checkout.

5. Refunds and Cancellations

5.1 One-Time Purchase Refunds

We offer a 30-day money-back guarantee for all one-time course purchases. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of your purchase date by contacting our support team. No questions asked.

5.2 Subscription Refunds

We offer a 7-day refund policy for subscription purchases. If you are not satisfied with your subscription, you may request a full refund within 7 days of your initial subscription payment or any renewal payment. After the 7-day period, subscription fees are non-refundable.

We provide renewal refunds as a courtesy to customers who may have forgotten to cancel before their renewal date. However, we reserve the right to deny refund requests in cases of suspected abuse, including patterns of repeated subscription renewals followed by refund requests.

5.3 Subscription Cancellation

  • You may cancel your subscription at any time through your account settings or by contacting our support team.
  • Cancellations take effect at the end of your current billing period. You will retain access to the course content until the end of the paid period.
  • No refunds or credits will be provided for partial months or years except as specified in Section 5.2.

5.4 Subscription Plan Changes

  • You may upgrade or downgrade your subscription plan at any time (e.g., from monthly to yearly, or yearly to monthly).
  • Plan changes take effect immediately.
  • When upgrading, you will be charged the pro-rated difference for the remainder of your current billing period.
  • When downgrading, you will receive a pro-rated credit applied to your next billing cycle.
  • You may also upgrade from a subscription to lifetime access. The upgrade takes effect immediately, your subscription will be cancelled, and you will receive a pro-rated credit for any unused subscription time applied toward the lifetime purchase price.

5.5 EU Consumer Rights

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days of purchase without giving any reason (EU Consumer Rights Directive). However, by accessing the course content before the 14-day period expires, you acknowledge that you are requesting immediate performance of the service and expressly waive your right of withdrawal. Our 30-day and 7-day refund policies exceed the statutory requirements and are provided as a customer service courtesy.

5.6 Refund Processing

Approved refunds will be processed within 5-10 business days and credited to your original payment method.

6. Account Registration and Security

6.1 Account Creation

To access our courses, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

6.2 Account Sharing

Your account is for your personal use and may be shared only with members of your immediate household. You may not:

  • Share your login credentials with individuals outside your household
  • Allow unauthorized access to your account
  • Sell, transfer, or assign your account to another person
  • Use your account for commercial purposes or to provide access to third parties

6.3 Account Security

You are responsible for all activities that occur under your account. Notify us immediately if you suspect any unauthorized access to your account.

6.4 Account Termination

We reserve the right to suspend or terminate your account if we believe you have violated these Terms, including but not limited to improper account sharing or fraudulent activity.

7. Intellectual Property Rights

7.1 Ownership

All course content, including but not limited to videos, audio files, lesson slides, transcripts, exercises, quizzes, Anki flashcard decks, text, graphics, logos, and other materials (“Content”) are the intellectual property of NattokuGo AB or our licensors and are protected by Swedish and international copyright laws.

7.2 License Grant

Subject to your compliance with these Terms:

  • One-time purchasers: You are granted a limited, non-exclusive, non-transferable license to access and use the purchased course content for your personal, non-commercial learning purposes. You may download lesson slides, transcripts, and other designated downloadable materials for your personal use. If you separately purchase Anki flashcard decks, you may download and use them for your personal study purposes only.
  • Subscribers: You are granted a limited, non-exclusive, non-transferable license to access and use the subscribed course content for your personal, non-commercial learning purposes during the active subscription period. Downloadable materials, if any, are for your personal use during your active subscription.

7.3 Restrictions

You may not:

  • Copy, reproduce, distribute, or create derivative works from any course content except as expressly permitted
  • Record, screenshot, or capture course videos or audio for distribution
  • Share, sell, rent, lease, or sublicense course content or materials to others
  • Remove or alter any copyright notices, watermarks, or proprietary markings
  • Use course content for any commercial purpose
  • Upload course content to any public or shared platform, including but not limited to file-sharing services, social media, or course piracy websites

7.4 Enforcement

Violation of these intellectual property rights may result in immediate termination of your access and may subject you to civil and criminal liability under applicable laws.

8. Content and Streaming Access

8.1 Streaming Content

Course videos and audio files are available via streaming only and cannot be downloaded unless explicitly provided as a downloadable resource.

8.2 Downloadable Materials

Certain materials such as lesson slides, transcripts, and supplementary resources may be available for download where indicated. Lifetime purchasers may also separately purchase Anki flashcard decks that contain course vocabulary and sentences. All downloadable materials are subject to the same usage restrictions as all other course content and may not be shared, distributed, or resold.

Note: Anki flashcard decks require the separate Anki software application to use. Anki is a third-party application that must be obtained separately from AnkiWeb or the respective app stores. 80/20 Japanese is not affiliated with Anki, and we provide no warranties regarding the Anki application’s functionality or availability.

8.3 Technical Requirements

You are responsible for ensuring you have:

  • A compatible device and browser
  • Sufficient internet bandwidth for streaming video content
  • Any necessary software or plugins

8.4 Content Updates

We may update, modify, or remove course content at any time to improve quality or accuracy. Lifetime access purchasers will receive all updates to their purchased course at no additional cost.

9. User Conduct

You agree to:

  • Use our services in compliance with all applicable laws and regulations
  • Provide accurate information when creating your account
  • Respect the intellectual property rights of 80/20 Japanese and others
  • Not use our services to harass, threaten, or harm others
  • Not attempt to circumvent any security features or access restrictions
  • Not use automated systems (bots, scrapers, etc.) to access our platform

10. Disclaimers and Learning Outcomes

10.1 Educational Service

Our courses are provided as educational services. While we strive to provide high-quality instruction, we make no guarantees or warranties regarding:

  • Specific learning outcomes or results
  • Achievement of language fluency or proficiency levels
  • Suitability for specific purposes (such as test preparation, professional requirements, or certification)
  • Speed of learning or comprehension

10.2 Individual Variation

Language learning outcomes vary significantly based on individual factors including prior knowledge, time invested, learning style, practice habits, and personal aptitude. Your results depend primarily on your own effort and commitment.

10.3 No Professional Advice

Our courses provide general language instruction and should not be considered professional, academic, or vocational advice. Consult appropriate professionals for specific language certification or professional requirements.

10.4 Service Availability

While we strive to provide uninterrupted access to our platform, we do not guarantee that our services will be available at all times. Our services may be temporarily unavailable due to maintenance, updates, technical difficulties, or circumstances beyond our control.

11. Limitation of Liability

11.1 To the Maximum Extent Permitted by Law

NattokuGo AB, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or content
  • Loss of learning time or educational opportunities
  • Any other intangible losses

11.2 Direct Damages

To the extent permitted by law, our total liability for any direct damages shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the liability.

11.3 Statutory Rights

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be limited or excluded under Swedish law

11.4 Consumer Protection

If you are a consumer in the European Union, these limitations of liability do not affect your statutory consumer rights under applicable EU consumer protection law.

12. Data Protection and Privacy

12.1 Privacy Policy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our collection and use of your information as described in our Privacy Policy.

12.2 Data We Collect

We collect only the personal information necessary for:

  • Account creation and management
  • Payment processing through our checkout system
  • Course delivery through our learning platform
  • Communication regarding your account and courses

13. Changes to Terms

  • Posting the updated Terms on our website with a new “Last Updated” date
  • Sending an email notification to your registered email address (for material changes)

13.2 Acceptance of Changes

Your continued use of our services after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must discontinue use of our services. For subscription users, you may cancel your subscription as described in Section 5.3.

13.3 Previous Purchases

Changes to these Terms do not retroactively affect the terms under which you made previous one-time purchases, except where legally required.

14. Applicable Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the Swedish courts.

14.3 EU Consumer Rights

If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence, and nothing in these Terms affects your statutory consumer rights under EU law.

14.4 Amicable Resolution

Before initiating any formal legal proceedings, we encourage you to contact us to attempt to resolve any disputes amicably.

15. Termination

15.1 Termination by You

  • One-time purchases: You may stop using our services at any time, but your lifetime access will remain unless you violate these Terms.
  • Subscriptions: You may cancel your subscription as described in Section 5.3.

15.2 Termination by Us

We may suspend or terminate your access to our services immediately if:

  • You violate these Terms
  • Your payment method fails and you do not provide updated payment information
  • We are required to do so by law
  • You engage in fraudulent, abusive, or illegal activity

15.3 Effect of Termination

Upon termination:

  • Your right to access and use our services immediately ceases
  • You must cease all use of any downloaded materials
  • No refunds will be provided except as required by law or as specified in our refund policy
  • Sections of these Terms that by their nature should survive termination shall remain in effect

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NattokuGo AB regarding our services and supersede any prior agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, or sale of assets.

16.5 Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.
